Terms of Service
Please read carefully: These Terms of Service (these "Terms") constitute a legally binding agreement between you ("you" or "your") and VideoGen.
These Terms govern your access and use of our websites where these Terms are posted (the "Sites"), our mobile applications (the "Apps"), and our related content, products, and services (collectively, and together with the Sites and the Apps, the "Service").
By downloading, installing or using the Service in any manner, you agree to these Terms and you agree to comply with and be bound by any applicable specific, supplemental or third-party licenses or terms when using the Service.
IF YOU DO NOT AGREE TO ALL TERMS AND CONDITIONS IN THESE TERMS, DO NOT ACCESS AND IMMEDIATELY STOP USING THE SERVICE, AND IMMEDIATELY UNINSTALL AND DELETE ANY COPIES OF ANY APPS OR SOFTWARE INCLUDED IN THE SERVICE IN YOUR POSSESSION.
These Terms were originally drafted in English. If there is any conflict between the English-language version of these Terms and a version translated into another language, the English-language version will prevail().
1. Changes to the Terms and the Service
We reserve the right to update these Terms at our sole discretion from time to time (for instance, when we modify or introduce new functionalities, technologies, or offerings, to adhere to legal, regulatory, or contractual mandates, or in light of exceptional or unforeseen events). In such instances, we will take reasonable steps to notify you based on the significance of the modifications, such as by updating the "Last Updated" date, sending an email, or providing a pop-up or push notification within the Service. You are responsible for reviewing the Terms and checking the Service for updates regularly. Unless specified otherwise, updated Terms become effective the moment they are posted within the Service. By continuing to access or utilize our Service after updates take effect, you consent to be bound by the revised Terms. If you disagree with the updated Terms, you must cease using our Service immediately and delete all copies of any Apps or software related to the Service in your possession.
Furthermore, we may update, modify, suspend, or discontinue the Service (or any specific portion, content, or feature) at any time, without prior notice and without liability to you or any third party (for example, to test new features or technologies, to improve or further develop the Service, to meet legal or regulatory obligations, or in response to unforeseen circumstances).
Please note that certain services and features might not be accessible in all countries, languages, or across all operating systems.
2. Eligibility
OUR SERVICE IS NOT INTENDED FOR INDIVIDUALS UNDER THE AGE OF 16. If you are at least 16 years old but under the legal age of majority in your jurisdiction, your parent or legal guardian must review and consent to these Terms on your behalf and must oversee your use of the Service.
YOU ARE PROHIBITED FROM ACCESSING OR USING THE SITES OR ORDERING, ACCESSING, OR UTILIZING THE SERVICE IF YOU: (A) DISAGREE WITH THESE TERMS, (B) HAVE NOT REACHED THE LEGAL AGE TO FORM A BINDING CONTRACT WITH US (UNLESS YOUR PARENT OR GUARDIAN HAS CONSENTED TO THESE TERMS AND YOUR USE), OR (C) ARE RESTRICTED BY APPLICABLE LAWS FROM ACCESSING OR USING THE SERVICE.
3. Prohibited Uses
You agree that you shall not, and shall not authorize any person accessing the Service via your device to:
• Use the Service in any manner that is not expressly authorized by these Terms;
• Utilize the Service for any objective prohibited by relevant laws or regulations, or in any way that infringes upon the rights of others;
• Import, upload, publish, transmit, or communicate any content that is unlawful, fraudulent, deceptive, harmful, defamatory, inaccurate, abusive, offensive, threatening, hateful, violent, harassing, discriminatory, or racist, or any content that violates another person's rights (including intellectual property, privacy, and publicity rights);
• Copy (except as explicitly permitted herein) or modify the Service;
• Frame, mirror, display, or integrate the Service or any portion of it into any other software, site, service, or product;
• Use the Service in a way that interferes with, diminishes, or disrupts the performance or integrity of our networks, technologies, or products;
• Employ any data mining, robots, or similar data extraction, gathering, or scraping techniques in connection with the Service;
• Circumvent, disable, or tamper with any content protection systems, digital rights management, or security features within the Service; or
• Permit others to engage in any of the aforementioned activities.
4. Our Intellectual Property Rights
We or our licensors retain exclusive ownership of all rights, title, and interest in and to the Service and its proprietary content (including software, artwork, photos, videos, audio, text, and other materials made available through the Service, excluding User-Generated Content). This includes all intellectual property rights, whether registered or unregistered, such as copyrights, patents, inventions (whether patentable or not), trademarks, service marks, trade secrets, know-how, trade dress, logos, and domain names, along with all associated goodwill and derivative works. We reserve all rights not expressly granted to you under these Terms.
5. User-Generated Content
The Service may offer features that permit you to upload, store, create, modify, share, or publish text, images, audio, or other materials (collectively, the "User-Generated Content").
We do not claim ownership rights over your User-Generated Content.
To operate, provide, and enhance the Service and our underlying technologies (and to develop new features), we require certain rights regarding User-Generated Content protected by intellectual property laws. You hereby grant us a license to utilize User-Generated Content for the purposes of operating, developing, and improving the Service or new offerings. However, we will only utilize your User-Generated Content to enhance machine learning model performance with your explicit prior consent, in alignment with our Privacy Policy. You will not receive compensation for our use of User-Generated Content under these Terms.
You bear sole responsibility for your User-Generated Content. You represent and warrant that such content does not violate any person's rights, complies with these Terms and applicable laws, and that you possess all necessary authorizations to grant the license above and to share the content via the Service.
We welcome feedback and suggestions for Service improvements ("Feedback"). If you provide Feedback, we may utilize it without restriction or compensation to you.
6. Generative AI Features
The Service may allow you to interact with features powered by generative artificial intelligence models (the "Generative AI Features"). These features may allow you to submit text, images, video, or audio as input ("Input"). Based on this Input, you may generate output content such as text, images, video, or audio ("Output"). Your Input and Output are categorized as User-Generated Content under these Terms and, as between you and us, belong to you.
Without limiting Section 3 (Prohibited Uses), while using Generative AI Features, you shall not, and shall not permit anyone using your account to:
• Upload, generate, or distribute content that facilitates the exploitation or abuse of minors, including child sexual abuse material or any portrayal of children leading to sexual exploitation;
• Create or distribute content that contains sexually explicit material, profanity, pornography, or content intended for sexual gratification;
• Facilitate dangerous, illegal, or malicious activities, including (a) promoting law violations, (b) disrupting services (spam, phishing, malware), (c) attempting to bypass safety filters or forcing the AI to act against these Terms, (d) generating content that discriminates against or harms individuals or groups, and (e) distributing content intended to misinform or exploit others;
• Upload or generate content that encourages the inappropriate or illegal use of alcohol, tobacco, drugs, explosives, firearms, or ammunition;
• Promote violence or incite hatred against groups based on race, religion, disability, age, nationality, sexual orientation, gender, or any characteristic associated with systemic marginalization; or
• Generate content depicting gratuitous violence or other hazardous activities.
7. Disclaimer of Warranties
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE (INCLUDING ALL CONTENT AND FEATURES) IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT ITS OPERATION WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. NO ORAL OR WRITTEN ADVICE FROM US SHALL CREATE A WARRANTY. SHOULD THE SERVICE PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY REPAIR OR CORRECTION, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DATA LOSS RESULTING FROM THE USE OF THE SERVICE.
8. Termination
These Terms remain in effect until you: (i) cease using our Service, and (ii) uninstall and delete all copies of the Apps in your possession. You may stop using the Service at any time.
We may terminate these Terms at any time for any reason by providing notice. Your rights under these Terms will end automatically if you fail to comply with any provision. Upon termination, (a) you must stop all use of the Service and delete all copies of the Apps, and (b) all licenses granted herein will immediately lapse. Provisions that by their nature should survive termination shall continue to apply.
9. Amendments to the Terms and the Service
We may update these Terms as we introduce or retire features, or to satisfy legal or business requirements. In such cases, we will inform you via email, pop-ups, or push notifications within the Service. It is your responsibility to check the terms for updates regularly. By continuing to use our Service after updates are effective, you agree to be bound by the revised Terms. If you do not agree, you must immediately uninstall the App and cease use.
